p.s. judge與justice在少數(shù)情況下可作為同義詞互用。但作為一般規(guī)則來說，這兩個詞是不完全相同的，對法官的通稱是judge,并且它包括了justice,但在一般語境中，justice不包括judge。在美國，對某一司法區(qū)中最高審級的法官通常稱為justice，而對初審和中間上訴審的法官稱為judge，即trial judge(但也有少數(shù)州例外，如紐約州初審法院的法官稱justice,而上訴審法官稱judge；在得克薩斯州，中間上訴法院的法官稱justice，而在初審法院及最高審級的刑事法院，即刑事上訴法院中的法官稱judge)

在刑事法庭審案期間由行政司法官選定并召集。其職責(zé)為受理刑事指控，聽取控方提出的證據(jù)，決定是否將犯罪嫌疑人交付審判，而不是認定其是否有罪。稱為「大」陪審團，因其成員的人數(shù)較通常的陪審團即小陪審團為多；普通法上由12-23人組成。

在英國，除個別情況外，大陪審團已于1933年取消；至1948年則被徹底廢除。美國憲法第五條修正案規(guī)定，對可能判處死刑的犯罪和不名譽罪的指控，原則上必須經(jīng)由大陪審團起訴。聯(lián)邦法院的大陪審團由16-23人組成。各州法院大陪審團的人數(shù)，則各有不同。
